This legislative push comes amid deep concerns that the FDA's decision, coupled with new guidance allowing pending products to be marketed, will spark a dangerous resurgence in youth tobacco use.
In their letter to the agency, the senators forcefully argued against the notion that flavored vapes are necessary for adult smoking cessation. They highlighted a lack of scientific consensus supporting adult benefits, contrasted with clear data showing that flavors are intentionally marketed to draw in young people.
Despite significant national progress in reducing underage vaping, the crisis persists. The 2025 Youth Tobacco Survey indicates that over 1.4 million middle and high school students remain active users.
The coalition, which includes prominent figures like Senators Dick Durbin and Elizabeth Warren, insists the FDA's current regulatory stance exacerbates the risk of chronic disease and death for a new generation.
