The Argentine government has published Resolution 549/2026, officially ending the nationwide ban on vaporizers, heated tobacco products, and nicotine pouches. This major policy shift aims to dismantle a massive black market by imposing strict quality controls, mandatory registration, and taxation.
For years, Argentina operated under a strict prohibitive model backed by the Ministry of Health and the national drug administration (ANMAT). However, government sources acknowledge this approach merely fueled an informal market where consumers accessed untraceable products with unknown compositions.
The new framework requires full traceability for all nicotine products. Manufacturers and merchants must declare all ingredients, adhere to strict limits on nicotine concentrations, and eliminate unauthorized substances. Any product sold without official registration will be deemed illegal.
A central pillar of the new regulation is the total elimination of flavorings in vapes. Authorities identified flavors as the primary driver of adolescent vaping initiation and aim to curb youth appeal through this restriction.

Despite the government's push to regulate the black market and formalize taxation, health professionals remain cautious about the expanding availability of these devices.
Dr. Carlos Sebastián Wustten, Head of Pulmonology at San Martín Hospital in Paraná, emphasized that these devices still deliver highly addictive nicotine. He warned that the long-term oncological effects of vaping remain uncertain.
"Everything that enters the lungs that is not air is bad and produces diseases, at the respiratory level and sometimes at the systemic level," Wustten stated, noting that expanding consumption is not a positive development from a medical perspective.
The government maintains that the intervention will ultimately reduce harm by establishing standards and decreasing secondhand smoke exposure from traditional cigarettes, citing similar regulatory successes in the United States, Sweden, and Japan.
