    Pennsylvania's Act 57 of 2025 mandates that all electronic nicotine delivery systems (ENDS) must be certified by the Office of Attorney General. By June 20, a public Vape Directory will dictate which products are legal for retail. Manufacturers face strict PMTA compliance checks, threatening unapproved e-cigarettes with immediate market removal.

    The Certification Hurdle and PMTA Enforcement

    This legislative shift places a heavy bureaucratic burden on the state's 11,090 Other Tobacco Product (OTP) license holders. To secure a spot on the continuously updated directory, manufacturers must submit non-refundable payments alongside proof of FDA authorization or pending Premarket Tobacco Product Application (PMTA) status. The state is effectively deputizing local authorities to enforce federal standards.

    The rules also target loopholes. Zero-nicotine products sharing a brand name with nicotine variants require rigorous chemical testing at a certified domestic lab to prove the absence of nicotine. Forms and bond documentation are now live on the Attorney General's ENDS portal, which strictly separates vape compliance from traditional cigarette certifications. For the industry, this signals a tightening regulatory noose aimed at purging illicit disposables from Pennsylvania shelves.
