A new bill, HB 389, proposes banning smoking in virtually all public spaces across Florida, including streets, beaches, and parks, starting July 1st. The legislation targets both tobacco and marijuana products, with a rare exception for unfiltered cigars, but it must still pass through three legislative committees before a final vote.

    Key Takeaways:

    • Broad Scope: Bans smoking on sidewalks, beaches, parks, and public buildings.
    • Substances Included: Covers cigarettes and marijuana derivatives.
    • Exception: Unfiltered cigars would remain exempt.
    • Timeline: If approved, the law takes effect July 1st.

Two Florida legislators have introduced a bill that could ban smoking in nearly all public spaces throughout the state. This development occurs amidst a broader legislative push, directly resulting in potential restrictions on both tobacco and marijuana use in common areas like streets and beaches.

    HB 389: A Sweeping Prohibition

Filed by Republican Representative Robert Andrade and Democrat Senator Debra Tendrich, Bill HB 389 defines "public space" extensively. The ban would apply to streets, sidewalks, highways, public parks, beaches, schools, hospitals, government buildings, and commercial establishments.

The legislation explicitly covers both tobacco products and marijuana derivatives. It also specifically prohibits smoking or vaporizing marijuana products in airport smoking rooms. The only notable exception in the bill is for unfiltered cigars.

    Next Steps for the Bill

Despite being introduced in November, HB 389 faces a rigorous process. It must clear three legislative committees before reaching a plenary vote. Currently, no dates have been set for these reviews. If successful and signed by the governor, the ban would become effective on July 1st.
