    FDA Authorizes JUUL2 System and Menthol Pods for US Market

    The US Food and Drug Administration (FDA) authorized the marketing of Juul Labs’ next-generation JUUL2 system and two nicotine pods on August 28, 2026. This decision permits the sale of the JUUL2 device alongside Virginia Tobacco and Polar Menthol pods, each containing 18 mg/ml of nicotine.

    This marketing granted order does not mean the FDA has approved these products as safe or medically cleared them for smoking cessation. Instead, the agency has determined that permitting these products to be marketed is appropriate for the protection of public health, weighing the benefits for adult smokers against the risks of youth uptake.


    FDA Evaluates Adult Switching Rates and Youth Risks

    To receive marketing authorization under the Premarket Tobacco Product Application (PMTA) pathway, manufacturers must provide scientific evidence showing their products benefit the overall public health. The FDA focused closely on how effectively the JUUL2 system helps adult smokers completely abandon combustible cigarettes.

    Data submitted by Juul Labs indicated that a substantial portion of adult smokers transitioned completely to the JUUL2 system during a six-week study. Depending on the specific trial parameters, between 20% and 50% of participants stopped smoking traditional cigarettes entirely. The transition rate was notably higher among those using the Polar Menthol pods compared to the tobacco-flavored pods.

    The FDA emphasized that health benefits are realized only when smokers switch completely to e-cigarettes. Dual users who continue to smoke traditional cigarettes alongside vaping do not experience the same reduction in toxin exposure.

    Menthol Flavor Authorization Remains Highly Regulated

    The authorization of the Polar Menthol pod is highly scrutinized, as flavored vaping products have been a focal point of regulatory debates in the US. Flavors are often criticized for attracting younger users to nicotine products.

    The FDA determined that the documented benefit of the Polar Menthol pod in helping adult smokers quit traditional cigarettes was strong enough to outweigh the potential risks of youth appeal. This decision follows years of regulatory challenges for Juul Labs. The FDA previously issued marketing denial orders for Juul's first-generation products in 2022, which were suspended and eventually reversed in 2024. In July 2025, Juul received marketing authorization for its original device and tobacco and menthol pods at higher nicotine strengths.

    To address youth access concerns, the new JUUL2 device features age-verification technology. Users can connect the device to a smartphone application that locks the e-cigarette until the user verifies their age.


    Authorized US Vape Market Expands Amid Youth Vaping Decline

    With the addition of the three JUUL2 products, the list of FDA-authorized e-cigarette products in the US has grown to 48. While these are the only e-cigarettes legally permitted for sale, a large market of unauthorized disposable vapes continues to circulate in retail channels.

    Federal data shows a downward trend in youth e-cigarette use. According to the 2025 National Youth Tobacco Survey, approximately 1.44 million middle and high school students reported vaping within the past 30 days, representing 5.2% of students. This is a decline from 1.63 million students (5.9%) in 2024. The survey also indicated that nearly 90% of youth vapers used flavored products, with disposable devices being the most common choice, while pod systems like Juul represented a smaller share of youth use.

    The FDA's decision has no direct legal effect outside the US. In the European Union, vaping products are regulated under the Tobacco Products Directive, which caps nicotine concentrations at 20 mg/ml. While the 18 mg/ml strength of the new JUUL2 pods complies with this limit, Juul must still secure separate regulatory clearances to sell these products in European markets.
